The purchase of goods and services from ACD Corporate Pty Ltd trading as Australian Computer Doctors is subject to the following terms and conditions. By purchasing or receiving goods or services from ACD Corporate Pty Ltd, you accept the following terms and conditions:


MANDATORY REPAIRED NOTICES

  • Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods; and
  • The repair of your goods may result in the loss of any user-generated data. Please ensure that you have made a copy of any data saved on your goods.

SERVICES

  • Any period or date for delivery of goods or provision of services stated by us is an estimate only. We will use best endeavours to meet any estimated dates for delivery of the goods or completion of the services and provide you with as much notice as possible of any expected delays.
  • You acknowledge and agree that we may need to take your system to our base or third party premises for diagnosis and repair. We will exercise all due care while in possession of your equipment to ensure that no loss or damage occurs.

QUOTATIONS

  • Any verbal quote given by ACD Corporate Pty Ltd is given as a guide based on the limited information given by a customer. A verbal quote is intended to give the customer an estimate of the price, and is not an assurance that the product or service will be sold at that price. ACD Corporate Pty Ltd attempt to inform their customers of all possible price options prior to arrival based on the information provided by the customer.
  • Any written quote given by ACD Corporate Pty Ltd is a guarantee that the product or service will be provided at that price. Any written quote is valid for a period of 7 days.
  • Any piece of advertising material stating a fixed price for a product or service is valid only for the period stated on the advertising material or at the date of publication and may or may not be honoured at the discretion of ACD Corporate Pty Ltd.

WARRANTY

  • ACD Corporate Pty Ltd offers a 30 day warranty on all computer repair services excluding software problems and issues deemed caused by a third party.
  • If any software is changed (either by yourself or as an automatic update) after ACD Corporate Pty Ltd’s work is completed, any issues arising from that change will not be covered under warranty.
  • Any fault deemed to have resurfaced as a result of miss-use by the user, will not be covered by this warranty. ACD Corporate Pty Ltd will determine whether an issue has not been resolved correctly or has resurfaced as a result of miss-use.
  • ACD Corporate Pty Ltd offers a 12 month warranty on all new hardware sold, and a 3 month onsite labour warranty (unless otherwise stated).
  • If an ACD Corporate Pty Ltd technician is called out to a premises for a warranty call, however it is deemed that the fault is not related to that particular piece of hardware, the customer will be charged the appropriate rate for that particular issue.

LIABILITY

  • ACD Corporate Pty Ltd will exercise reasonable care in handling any equipment which you provide to it.
  • You agree to indemnify and will keep ACD Corporate Pty Ltd indemnified against any claim, demand, injury, damage, loss, expense, cost or liability (whether direct or indirect) made against or suffered by ACD Corporate Pty Ltd in connection with your equipment, your breach of these Terms and Conditions or your breach of any rights of third parties.
  • Where ACD Corporate Pty Ltd is liable to you under the Australian Consumer Law, to the fullest extent permitted by law, its liability shall be limited, in its option, to:
    • in relation to goods:
    • the replacement of your goods or the supply of equivalent goods;
    • the payment of the cost of replacing your device or of the supply of an equivalent device; or refunding the amount of your order, and
    • in relation to services:
    • supplying of the services again; or
    • payment of the cost of having the services supplied again.
  • ACD Corporate Pty Ltd will in no way be liable to the customer or any third party for any accidental, consequential or indirect damages resulting from the provision of the service. This includes but is not limited to:
    • Damage to hardware
    • Corruption or damage to software
    • Data loss or data corruption
    • Any damages related to downtime, interruption of business services, loss of profit or damage to goodwill.

PAYMENT

  • Payment for ACD Corporate Pty Ltd goods or services must be made by cash, direct deposit or credit card. Payment must be made directly on completion of work, or at the time requested by ACD Corporate Pty Ltd. No credit terms are provided without prior approval from management.
  • ACD Corporate Pty Ltd services that are charged at an hourly rate have a minimum charge of 1 hour labour.
  • All goods supplied by ACD Corporate Pty Ltd are charged separately from the services.
  • All visits by ACD Corporate Pty Ltd are chargeable unless, ACD Corporate Pty Ltd is unable to diagnose or suggest a solution to a customer’s problem.
  • ACD Corporate Pty Ltd may vary its price for goods and services without giving notice to the customer.
  • All services offered by ACD Corporate Pty Ltd are subject to our cancellation policy. If you give us less than twenty-four (24) hours’ notice to cancel any request for onsite service, then we will charge a cancellation fee equal to the first hour of service at the rates quoted at the time of booking for the loss and expense caused. All telephone calls are recorded to confirm your consent of this policy.

CUSTOMER'S RESPONSIBILITIES

  • You represent and warrant to ACD Corporate Pty Ltd that you are the owner of, and/or have the right to be in possession of all equipment, data or media provided to ACD Corporate Pty Ltd for repair. You further represent that you have the right to authorise ACD Corporate Pty Ltd to carry out repairs on your equipment.
  • You must back up all software, data and files that are stored on your computer and/or on any other storage devices you may have prior to the arrival of the ACD Corporate Pty Ltd technician. We and/or our third party service provider shall not be responsible at any time for any loss, alteration or corruption of any such software, data or files.
  • You warrant to ACD Corporate Pty Ltd that you hold all necessary licenses and approvals for any software item you request ACD Corporate Pty Ltd to install on your computer equipment. You agree to indemnify us and hold us harmless against any loss, damage, costs, harm or other expense whatsoever arising either directly or indirectly as a result of us installing software at your request. You must ensure that a person of at least 18 years of age is present for the duration of the provision of onsite services.
  • All visits by ACD Corporate Pty Ltd are chargeable unless, ACD Corporate Pty Ltd is unable to diagnose or suggest a solution to a customer’s problem.
  • ACD Corporate Pty Ltd may vary its price for goods and services without giving notice to the customer.
  • All services offered by ACD Corporate Pty Ltd are subject to our cancellation policy. If you give us less than twenty-four (24) hours’ notice to cancel any request for onsite service, then we will charge a cancellation fee equal to the first hour of service at the rates quoted at the time of booking for the loss and expense caused. All telephone calls are recorded to confirm your consent of this policy.
  • You must provide our technicians with:
    • access to the areas of your premises necessary to provide services;
    • necessary passwords to your computer;
    • a safe working environment and working space; and
    • electrical power and internet access (where applicable).
  • If the services involve the installation of software, then you must provide our technicians with the installation disks for your operating system or software along with a product key for this software.

NO FIX - NO FEE

  • If ACD Corporate Pty Ltd is unable to diagnose the cause of any software or computer hardware problem, nor suggest a suitable resolution to the problem (which may involve the need to purchase additional hardware or software) then no charge will apply to the customer.
  • Any service provided by the ACD Corporate Pty Ltd will be provided free of charge, only where ACD Corporate Pty Ltd is unable to diagnose the cause of a problem or suggest a suitable solution. ACD Corporate Pty Ltd will, at its sole discretion decide whether a service will be provided free of charge.
  • If an ACD Corporate Pty Ltd technician has the skill to resolve an issue, and the customer chooses not to proceed with their recommendation – standard fees and charges are payable to ACD Corporate Pty Ltd.

SAME DAY SERVICING

  • All requests for same day service are honoured on a best effort basis but may not always be possible due to illness or periods of staff leave. ACD Corporate Pty Ltd apologises in advance if we are unable to provide same day service to you for any reason.
  • We do not guarantee that all necessary work can be completed at the initial appointment.

FEEDBACK

  • You agree that we may use any written feedback you provide to us on our website and otherwise for marketing purposes without needing to obtain your further consent to do so.
